Subject: Consider a resolution of intention to amend Resolution No. 19818 that created Special Improvement Lighting District No. 222 to alter the boundaries by adding sixteen streetlights and to remove property in SILD No. 222 in the city of Helena, Montana.
Present Situation:

Special Lighting District No. 222 with sixty-four (64) street lights was created with Resolution No. 19818 on March 14, 2011; The City Commission considered and passed Resolution No. 19856 adding five (5) more streetlights on July 25, 2011; The City Commission considered and passed Resolution No. 20085 adding five (5) more lights on June 23, 2014; The City Commission considered and passed Resolution No. 20190 adding seventeen (17) more street lights on July 27, 2015; The City Commission considered and passed Resolution No. 20430 adding eight (8) additional street lights on February 26, 2018 for a total of ninety-nine (99) lights in Special Lighting District No. 222.

Since February 2018, an additional three phases in the Mountain View Meadows Subdivision have been completed adding sixteen (16) more streetlights.

The Developer, R&D Properties, LLC has petitioned the City to amend SILD No 222 to add these additional streetlights to the district. This amendment would add 26 new lots and the Aspen Condos development to the district. R&D Properties had transferred ownership of 24 of the 26 lots to new owners and retains ownership of the Aspen Condo development.

In addition, R&D Partners, LLC is requesting to remove property known as Tract 2-A-2, Property ID No. 45445, GEO Code No. 05-1888-35-2-09-01-000 totaling 479,682.72 square feet from the district. By removing the undeveloped land from the district, the cost of maintaining the streetlights will be reallocated to the other property owners.

All costs of installing and maintaining the streetlights is borne by the property owners.


Background Information: Amend SILD No. 222 to add sixteen (16) additional lights to the assessment area.

With the consent of this Resolution of Intent, the City will notify all property owners affected by the amendment to SILD No. 222 to add 16 lights and amend the boundaries of the district. The notice will contain an estimated cost per square foot of maintaining the lights and the cost energy of the assessment changing from $0.187 to $0.256 per square foot of property owned.

Proposal/Objective: Amend SILD No. 222 to add sixteen (16) additional lights to the assessment area.

With the consent of this Resolution of Intent, the City will notify all property owners affected by the amendment to SILD No. 222 to add 16 lights and amend the boundaries of the district. The notice will contain an estimated cost per square foot of maintaining the lights and the cost energy of the assessment changing from $0.187 to $0.256 per square foot of property owned.

Advantage: The benefits of street lighting are the convenience, safety, and security of property and improvements.
Notable Energy Impact: Lights are up-fitted with LED Lexington-American luminaries with lamp wattage of 42.
Disadvantage: Property owners may determine the addition of the lights and the removal of the undeveloped land from the district to be a burden. The Property Developer will have to absorb the cost of installing and maintaining lights.
