Present Situation:
|
The applicant is requesting a zone change from the DT (Downtown) District to the TR (Transitional Residential) District to allow for the higher density of development of ground-level residential uses and compatible commercial uses. This change in the density and location of uses would serve as a transitional buffer to the type and intensity of uses found to the northwest of the proposed zone change lot where a neighborhood of R-3 (Residential) District uses exist.
The proposed zone change is in conformance with the 2019 Growth Policy in promoting the creation of housing and infill development while also promoting mixed-use development that is consistent with the Future Land Use Map. The proposal also satisfies the statutory requirements of MCA 76-2-304 that assure zoning regulations adhere to appropriate guidelines in support to public health, safety, and general welfare through the adequate provision of public utilities services and safety from hazards that could cause blight. In consideration of the conformance with the 2019 Growth Policy and MCA statutory requirements, the Helena Zoning Commission voted 3-0 to recommend approval of the zone change at 739 Getchell Street on May 11, 2021.

Advantage:

The zone change proposal will allow for the current property owner to redevelop 739 Getchell as higher density, mixed-use property, with a blend of housing and commercial uses within the downtown core. The zone change is for a property with limited redevelopment potential resultant from a singular point of access and 30-foot grade separation on the eastern portion of the property. The massing of structures on the parcel will be lower density with respect to height owing to a 36-foot height limitation, which helps to promote a transitional buffer with the nearby R-3 (Residential) District. |
