The City of Helena staff recommends removal of Section 2-1-3 of the City Ordinance and align it with the voter approved City Charter responsibilities of the Commission. The City Charter establishes that it is the City Manager’s responsibility to administer and manage City employees including develop, modify, add, and remove personnel policies for efficient and effective personnel management.
According to the City Charter, the Commission must adopt the employee appeals procedure, which is administered by the City Manager. The additional ordinance requirement is counter to the City Manager's Charter responsibilities.
The Commission addresses administration and employees only in a formal manner through the City Manager. Administrative functions are not delegated to individual members of the Commission. Personnel policy development and revision has historically been governed by the City Commission outside the City Charter role. Department Heads are selected and supervised by the City Manager. Employees are supervised and managed by Department Heads under the City Managers direction and authority.
It is recommended to repeal Section 2-1-3 of the Helena City Code and revise it to be in alignment with the City Charter ensuring the Commission is responsible for adopting the employee appeals process. |
